Inter-American Court of Human Rights strongly against child detention

 

The Inter-American Court of Human Rights recently made clear in an Advisory Opinion on the Rights of Children in the Context of Migration, immigration detention is never in the best interests of the child and therefore is always a child rights violation.

Rather than resorting to immigration detention, states must “choose alternative measures to detention for the family, which are appropriate to the needs of the children.”

The Campaign views this as support from a regional mechanism to the Recommendation that came from the UN Committee on the Rights of the Child early last year, that children should not be detained on the basis of their, or their parents, migration status.
